The rapid development of digital technologies and artificial intelligence systems is significantly impacting the nature of social relations.
According to Oxu.Az, this was stated by Farhad Abdullayev, Chairman of the Constitutional Court, at the International Baku Summit of Ombudsmen on "Human Rights in the Era of Artificial Intelligence: Opportunities, Risks and Responsibilities."
He noted that AI is no longer just a technological innovation but has become an integral element of public administration, economic relations, information security, judicial activities, and mechanisms for the exercise of human rights.
"On the one hand, this process creates important opportunities for increasing the efficiency of public services, rapid data processing, expanding citizens' legal protection capabilities, and improving public governance. On the other hand, it raises new legal challenges related to personal data protection, legal liability, algorithmic discrimination, digital surveillance, and the protection of fundamental rights."
Therefore, the development and application of AI must be assessed in the context of the rule of law, constitutional guarantees, and international human rights standards.
Abdullayev stated that this approach is also reflected in Azerbaijan's constitutional legal system: "In accordance with the principles of the rule of law established by national leader Heydar Aliyev, the Constitution of the Republic of Azerbaijan enshrines the protection of human rights and freedoms as the highest goal of the state."
Today, Azerbaijan's policy in the field of AI is an important part of the state's digital development strategy. It is no coincidence that the "Artificial Intelligence Strategy of the Republic of Azerbaijan for 2025-2028," approved by President Ilham Aliyev's decree on March 19, 2025, defines a unified strategic vision for the development of this field in the country.
The strategy identifies key priorities such as forming an AI ecosystem, promoting innovations, strengthening highly qualified personnel potential, creating modern infrastructure, ensuring data security, and improving the ethical and legal framework. This document is not just a programmatic document focused on technological progress but also a manifestation of a modern management philosophy based on protecting human rights, transparency, accountability, and the principle of human control.
In this context, the main criterion in the application of AI technologies is ensuring the priority of human rights. Every technological mechanism affecting human rights must operate in accordance with the principles of legality, legitimate purpose, proportionality, and legal certainty.
