In some cases, cemeteries are located near residential areas. What does the law say about this?
Today's topic of Oxu.Az's "What does the law say?" rubric is about the rules for allocating land for cemeteries.
How far should a cemetery plot be from residential settlements? This issue is regulated by the "Rules for the establishment and management of cemeteries" approved by the Cabinet of Ministers.
According to the rules, land plots for cemeteries should be allocated near residential areas. In this case, a sanitary protection zone of at least 300 meters must be provided between the cemetery and residential and public buildings, agricultural facilities, as well as food production enterprises.
However, there is an exception to this rule. In rural settlements, considering the groundwater level and based on the opinion of the Ministry of Health, the distance between the cemetery and residential and public buildings, agricultural facilities, and food production enterprises may be reduced to 100 meters.
For interest, note that after 25 years from the last burial in a closed cemetery, the distance between it and the residential area can also be reduced to 100 meters based on the opinion of the Ministry of Health.
