A divided federal appeals court declined to reconsider a ruling that opens the door to the Trump administration rearresting and deporting pro-Palestinian activist Mahmoud Khalil.
The 3rd U.S. Circuit Court of Appeals voted 6-5 against Khalil's request to revisit a January panel decision that a lower court lacked jurisdiction to order his release.
Six Republican-appointed judges formed the majority, while five Democratic appointees dissented.
Judge Cheryl Ann Krause warned the decision handcuffs the judiciary's ability to protect civil liberties of non-citizens.
Khalil's lawyer vowed to appeal to the Supreme Court.
