A U.S. federal judge dismissed the indictment against Salvadoran migrant Kilmar Abrego on Friday.

The judge found that the Trump administration would not have prosecuted him had he not challenged his deportation.

Abrego was sent to a megaprison in El Salvador in March but was returned after the Supreme Court ordered his return.

The judge stated that the Justice Department only reopened the investigation after Abrego filed his lawsuit.
