According to the Supreme Court, Judge Gulnar Jabbarova from Sumgait Appellate Court provided an explanation.
She stated that alimony is calculated from the date the claim is filed in court. For example, if a citizen filed a claim on February 1, 2025, alimony is deducted from that date.
The date of the court decision does not matter. Alimony decisions are enforced immediately. Appeals or cassation complaints do not stop enforcement.
Even if the decision is overturned, paid alimony is not refunded. Failure to pay alimony may result in administrative or criminal liability.
