Khalaya Aliyeva, chief specialist of the Medical Control Department of the Analytical Expertise Center of the Ministry of Health, explained who is responsible for license violations in private clinics.
She stated that if a private medical institution is organized as a legal entity (LLC, JSC, etc.), the entrepreneur, not the doctor, is responsible for the license. The license falls entirely under the responsibility of the business entity.
Doctors are directly liable only if they operate individually or as both a doctor and an entrepreneur. When a license violation is detected, the business entity may face financial sanctions or more severe restrictive measures.
