A US federal court has struck down Donald Trump's $100,000 fee on H-1B visas for high-skilled foreign workers. The court ruled the fee illegal, stating Congress did not authorize it.
Judge Leo Sorokin said the fee is a tax, not a penalty. He argued Trump lacked Congressional approval to impose such a tax.
Before Trump's order, employers typically paid between $2,000 and $5,000 for H-1B visas. The program annually issues 65,000 visas, plus 20,000 for advanced degree holders.
The White House expressed confidence the ruling will be overturned on appeal.
