Bank Respublika OJSC has been taken to court. Plaintiffs Masim Zulfugarov and Toghrul Zulfugarov filed a claim with the Ismayilli District Court.
They stated that the enforcement action violates Article 63.1.3 of the Law and Article 29.4 of the Constitution.
The plaintiff owns a DAF 105 XF truck, valued at 45,000 manats by the bank and held as collateral.
A court decision was needed to first direct the debt to the debtor's assets. The notary, however, made the enforcement entry without investigation.
The court did not grant the plaintiffs' request.
